Double Yellow Television is a television production company committed to protecting and respecting your personal data and privacy.

This notice outlines:

Personal Data We May Collect from You:

Information from You - You may give us personal information about yourself by filling in company employment forms, contributor release forms, location release forms, sending emails, or in response to questions over the phone. The Personal Data may be submitted in hard copy form e.g. original or copied paper documents, photographs and film and stock footage; or electronic form e.g. PC, laptop, mobile phone, blackberry, memory stick or other mass storage drive/device. The information you give us may include (but is not limited to): your name, address, phone number, email, age, personal description, photograph or vehicle registration.

Information from Other Sources -  We may collect information about you from other sources, including newspaper articles, TV interviews, interviews with friends and family, your social media accounts etc.

 

Sensitive Personal Data - We may collect sensitive personal information from you including information about your racial or ethnic origin, your religious or other beliefs and offences or alleged offences committed by you.

Why we collect your Personal Information:

  • For you to take part in one of our productions

  • For you to work on one of our productions

  • For you to provide services for one of our productions

  • As part of research for production idea development

  • To enable the creation, broadcast or sale of our productions

  • For physical or system security

  • Providing details in connection with your seeking to participate on another production

  • Monitoring of diversity and equal opportunities

  • Disputes and legal proceedings

  • Day to day business operations including marketing and travel on our behalf

  • Maintaining appropriate business records during and after your participation in a programme

Why we process your Personal Information:

The lawful basis for Double Yellow Television to collect personal data is as follows:  

  • Consent: you have given clear consent for Double Yellow Television to process your personal data for a specific purpose

  • Contract: the processing is necessary for a contract Double Yellow Television has with you, or because you have asked Double Yellow Television to take specific steps before entering into a

  • Legal obligation: the processing is necessary for Double Yellow Television to comply with the law (not including contractual obligations) e.g information about contributors taking part in our productions i.e. background checks, references, any checks we make to verify information. We might also process information about your medical records or disability to ensure we make necessary adjustments for filming (for example)

Use of Sensitive Personal Data:

We shall process and use all sensitive personal data in a manner that complies with the additional requirements relating to sensitive personal data as set out in the GDPR. We will only collect Sensitive Personal data with your express consent for the following reasons:

  • To comply with employment law obligations.

  • To carry out our obligations arising from any contracts entered into between you and us and to provide you with the information, products and services that you request from us.

Disclosure of Personal Data:

Employees and freelancers working for us will have access to or will routinely acquire Personal Data about you. These include past, current and future employees, contributors, suppliers and contractors.


Within Double Yellow Television, managers, other employees and freelancers will only have access to the personal information they require from you in order to fulfil the properly authorised requirements of their jobs. Disclosure may be necessary and may properly occur between employees in the company.

 

Double Yellow Television is concerned to ensure that we monitor the sex and diversity of employees, freelancers, suppliers, contributors and talent. Data held about the above will be used for equal opportunities and requirements under the Diamond reporting system for relevant productions.

We may also share your personal information with selected third parties including:

  • Business partners, suppliers and sub-contractors for the performance of any contract that we enter into with them.

  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or applyterms of use or terms and conditions of supply and other agreements; or to protect the rights, property, or safety of Double Yellow Television, our employees or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

  • Please note that Sensitive Personal Data will not be shared with third parties without your consent.  

Specific circumstances in which your personal data may be disclosed include:

  • Disclosure to external recipients of electronic communications (such as emails) which contain your personal data;

  • Disclosure of aggregated and anonymised diversity data to relevant regulators as part of a formal request;

  • If you have an on-screen role, disclosure of footage, images, or audio recordings of you as part of the broadcasting, distribution and marketing of the production. Or, whether you have an on-screen or off-screen role, to allow us to credit your role.

  • External use: We will only disclose your personal data outside of Double Yellow if disclosure is consistent with a ground for processing on which we rely and doing so is lawful and fair to you. We may disclose your data if it is necessary for our legitimate interests as an organisation or the interests of a third party (but we will not do this if these interests are over-ridden by your interests and rights in particular to privacy).


On some occasions we or third parties may rely upon exemptions to data protection rules in relation to journalistic freedom, the right to artistic expression or more generally, the right to freedom of expression (as mentioned in article 85 of the General Data Protection Regulation and in various jurisdictions’ data protection rules, for example in the UK’s Data Protection Bill section on the exemption for ‘journalistic, academic, artistic or literary purposes’.

Where we store your personal data:

The data we collect from you may be may be transferred to, and stored at, a destination outside the European Economic Area ('EEA') It may also be processed by staff operating outside the EEA who work for us or one of our suppliers. Such staff maybe engaged in, among other things, production and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

Security:

Double Yellow Television is committed to adhering to the GDPR’s ‘Security Principle.’ Double Yellow will regularly review how it stores all Personal Data, including for those individuals whose Personal Data is collected during the course of making a programme and assess whether the security measures in place can be improved. Appropriate measures will be taken to prevent unauthorised access to personal data.  Aspects to be considered will include:

 

  • Physical security of drives, printouts and manual data.

  • Secure sitting or locking of computer terminals, personal computers and manual records

  • Password protection and other software controls

  • The ability to restore access to personal data in the event of any incidents from a secure back up.

  • Our server provider uses TLS/SSL encryption, applied when information is transferred from a DY device to our DY servers. Our files are stored on at least three server locations in a highly secure data storage area. Any paperwork containing personal information is kept in a locked cupboard.

 

All security measures are appropriate to risk.

How long we store your data for:

Although there is no specific period for which we will keep your personal data, we will not keep it for longer than is necessary for our purposes.  In general, we will keep your personal data until our production has been produced and for a period afterwards.  In considering how long to keep it, we will take into account its relevance to our business and your participation either as a record or in the event of a legal claim.

If your data is only useful for a short period (for example, CCTV), we may delete it. Some data, such as production footage itself and credit information, will be kept indefinitely as we have an ongoing legitimate interest in retaining the product.

Your Rights:

You have the right to access the information held about you. If you would like specific information, please contact a member of the Double Yellow team – you can do this via this website using the contact us button.

You also have a legal right to make a “subject access request”.  If you exercise this right and we hold personal data about you, we are required to provide you with information on it, including:

  • Giving you a description and copy of the personal data

  • Telling you why we are processing it

 

If you make a subject access request and there is any question about who you are, we may require you to provide information from which we can satisfy ourselves as to your identity.

As well as your subject access right, you may have a legal right to have your personal data rectified or erased, to object to its processing or to have its processing restricted.  If you have provided us with data about yourself, for example your address, you have the right to be given the data in machine readable format for transmitting to another data controller.  This only applies if the ground for processing is consent.

If we have relied on consent as a ground for processing, you may withdraw consent at any time – though if you do so that will not affect the lawfulness of what we have done before you withdraw consent.

Changes to Our Privacy Policy:
Our privacy policy may be updated from time to time. Please check back for frequently for updates.
